These Terms of Service ("Terms") govern your access to and use of foundinghunt.com (the "Site"), operated by FoundingHunt ("we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to use the Site. By using the Site, you represent that you meet these requirements.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Post false, misleading, or fraudulent content
- Impersonate any person or entity
- Attempt to gain unauthorised access to any part of the Site
- Use the Site to distribute spam or unsolicited communications
- Scrape, crawl, or extract data from the Site without our written permission
3. Founder Listings
Verification
Job listings are subject to our verification process, which reviews submissions against our eligibility criteria: meaningful equity, founding roles, and direct posting by a founder or authorised representative of the company. Submission of a listing constitutes your representation that the information provided is accurate and meets these criteria.
We reserve the right to reject, remove, or request amendment of any listing that does not meet our criteria or that we determine, at our sole discretion, is inappropriate, misleading, or in violation of these Terms.
Listing content
You are solely responsible for the content of your listing. By submitting a listing, you represent that:
- You have authority to post on behalf of the company
- All information provided is accurate and not misleading
- The listing does not violate any applicable law or third-party rights
4. Payments
Fees
Paid listing products are available at the rates published on the Site at the time of purchase. All fees are in USD and exclusive of any applicable taxes.
Billing
Payments are processed by Polar. By purchasing a paid product, you authorise the applicable charge through Polar. Any recurring billing, renewal, and cancellation terms presented at checkout apply to that purchase.
We are reviewing the current Polar product configuration and do not state a separate general renewal or cancellation policy here.
Refunds
Refund requests are assessed on a case-by-case basis. We are under no obligation to issue refunds and will consider factors including the reason for the request and whether the listing was published. Contact support@foundinghunt.com to submit a refund request.
5. Candidate Use
Candidates may submit a job-alert subscription request by providing an email address and role preferences. The email-delivery lifecycle, including frequency and unsubscribe controls, is still being finalised and is not promised by these Terms.
FoundingHunt does not facilitate applications directly. Any engagement between candidates and founders occurs outside the Site and is solely the responsibility of the parties involved.
6. Intellectual Property
All content on the Site — including text, design, logos, and code — is owned by or licensed to FoundingHunt and is protected by applicable intellectual property laws.
You retain ownership of content you submit (e.g. job listings). By submitting content, you grant FoundingHunt a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Site and in connection with our services.
7. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The Site will be uninterrupted or error-free
- Listings are accurate, complete, or current
- Any hiring outcome will result from use of the Site
FoundingHunt does not verify the financial condition, legitimacy, or equity practices of any company listed on the Site beyond our stated verification criteria.
8. Limitation of Liability
To the fullest extent permitted by law, FoundingHunt and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to lost profits, lost data, or employment outcomes.
Our total liability to you for any claim arising from these Terms or your use of the Site will not exceed the amount you paid to us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless FoundingHunt and its affiliates from any claims, losses, or damages (including reasonable legal fees) arising from: (a) your use of the Site; (b) content you submit; or (c) your breach of these Terms.
10. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason including breach of these Terms. Paid listing fees are non-refundable upon termination for breach.
11. Governing Law
These Terms are governed by the laws of Delaware, United States, without regard to its conflict of law provisions. Any disputes will be subject to the exclusive jurisdiction of the courts of Delaware, United States.
12. Changes to These Terms
We may update these Terms at any time. Changes will be effective upon posting to the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
